This Privacy Policy ("Policy") describes how wEX ("we," "us," or "our"), a decentralized peer-to-peer (P2P) multi-chain aggregator platform, collects, uses, stores, and discloses information obtained from users ("you" or "your") when using our website at wex.finance , mobile applications, and related services (collectively, the "Platform"). We prioritize maximum privacy and anonymity, in line with the nature of decentralized finance (DeFi), while complying with applicable laws.

wEX is a platform facilitating anonymous P2P transactions involving fiat currencies and stablecoins, utilizing Proof of SocialFi (PoSFI) for reputation scoring without mandatory KYC. For the purposes of this Policy, "anonymity" or "anonymous data" means that your personal information (such as wallet addresses, Twitter, or Telegram handles) is hidden from counterparties and other Platform users (unless you explicitly choose otherwise, e.g., via sharing in chats or settings). However, the Platform itself has access to and processes this data for operational purposes, and we may disclose it to authorities upon lawful request. We minimize the collection of personal data, emphasizing privacy. By using the Platform, you consent to this Policy. If you do not agree, please do not use the Platform.

1. Definitions

  • Personal Information: Any data that could identify you directly or indirectly, such as IP address, geolocation, wallet addresses, or linked social profiles (e.g., Twitter or Telegram).
  • Anonymized Data: Data from which identifiers have been removed, used for analytics without linking to specific users. Note that while data is anonymized for external sharing, the Platform retains access to underlying data for internal use and may de-anonymize it if required by law.
  • PoSFI Data: Information on social activity (e.g., scores from Ethos, Kaito, Moni), used for reputation calculation.
  • Transactional Data: Details of P2P trades, such as volumes, currencies, and statuses, stored on the blockchain.
  • Cookies and Trackers: Files or technologies for enhancing user experience.

Terms not defined here have the meaning set forth in the Terms of Use.

2. Acceptance of Policy

Accessing or using the Platform implies your consent to this Policy. We may update the Policy at any time by posting changes on the Platform. Continued use after an update constitutes acceptance of the changes. We recommend reviewing the Policy periodically.

3. Information Collection

We collect the minimal amount of data necessary for functionality, security, and Platform improvement. Types of information collected:

  • Information You Provide:
    • During Registration: Wallet connections (Web3), social accounts (Telegram, X/Twitter) for PoSFI.
    • During Transactions: Geolocation (auto or manual), trade parameters (currency, amount, method), in-app chat messages.
    • Reviews and Ratings: Anonymized post-trade feedback (hidden from other users unless specified).
  • Automatically Collected Information:
    • Device and Browser: IP address, device type, OS, browser for analytics and security.
    • Usage: Activity logs, such as offer views, session times.
    • Cookies: For storing preferences, sessions, and analytics (e.g., Google Analytics, if applicable).
  • Data from Third Parties:
    • Social Platforms: Reputation scores (Ethos, Kaito, Moni) with your consent.
    • Blockchain: Public transaction data (wallet addresses, but without personal linkage to external parties; Platform retains internal access).

We do not collect sensitive information (e.g., racial, medical data) and avoid mandatory KYC. Geolocation is used solely for localizing offers and can be disabled. All collected data is hidden from counterparties and other users by default, but the Platform has full access for processing and may provide it (e.g., wallets, Twitter, Telegram) to authorities if legally required.

4. Use of Information

Collected data is used for:

  • Providing Services: Processing transactions, matching offers, calculating PoSFI scores, moderating reviews. Data is kept anonymous to counterparties unless you choose to reveal it.
  • Improving the Platform: Analyzing usage to optimize interfaces, detect bugs.
  • Security: Detecting fraud, preventing abuses (e.g., chat spam).
  • Marketing: Anonymized data for internal research; we do not send personalized ads without consent.
  • Legal Compliance: Fulfilling obligations, such as AML checks in rare cases, which may involve accessing and potentially disclosing underlying data (e.g., wallets, Twitter, Telegram) to authorities.

PoSFI data is used solely for reputation assessment and fee reductions, without disclosing personal details to counterparties (unless you opt to share).

5. Disclosure of Information

We do not sell or rent your personal information. Disclosure may occur only in the following cases:

  • To Counterparties in Transactions: Only PoSFI scores and necessary details (no personal data such as wallets, Twitter, or Telegram unless you explicitly choose to share).
  • To Service Providers: Third parties (e.g., hosting, analytics) under strict NDAs and only for operations.
  • Legal Requirements: Upon request from authorities if required by law (e.g., for fraud investigations), which may include providing access to data such as wallet addresses, Twitter, or Telegram handles that the Platform holds.
  • Merger/Sale: In corporate changes, with privacy preserved.
  • Anonymized Data: For analytics or sale to institutional clients (without identification to them; however, the Platform retains the ability to link back to original data if needed for legal reasons).

We aim for minimal disclosure, especially given the decentralized nature, but the Platform's access to data allows for compliance with lawful requests.

6. Storage and Security

  • Storage: Data is stored on secure servers (centralized for backend, decentralized for blockchain data). Retention period: While account is active + 7 years for legal needs. The Platform has visibility into stored data for operational and compliance purposes.
  • Security: We employ encryption (HTTPS, end-to-end for chats), firewalls, regular audits. However, DeFi involves risks (e.g., blockchain attacks); we do not guarantee 100% protection. Data is anonymized for user interactions but accessible to the Platform, and may be provided to authorities (e.g., wallets, Twitter, Telegram) upon request.
  • Access: You can hide data in settings; blockchain transactions are public but anonymous to external parties (Platform retains internal linkages).

7. Your Rights

Depending on your jurisdiction (e.g., GDPR for EU residents), you have rights to:

  • Access: Request a copy of your data.
  • Rectification: Update inaccurate data.
  • Deletion: Delete your account and data (except immutable blockchain data).
  • Withdrawal: Revoke consent to processing (may limit services).
  • Portability: Receive data in a structured format.

10. International Data Transfers

Data may be transferred outside your jurisdiction (e.g., to EU or US). We ensure adequate protection through contracts.

We will notify of material changes via the Platform or email (if provided). Continued use constitutes acceptance.

12. Governing Law

This Policy is governed by the laws of the Cayman Islands. Disputes shall be resolved through arbitration under AAA Rules or in courts of the jurisdiction.
